CRC 1.10(b): "Unless otherwise provided by law, if the last day for the performance of any act that is required by these rules to be performed within a specific period of time falls on a Saturday, Sunday, or other legal holiday, the period is extended to and includes the next day that is not a holiday." CCP 12: "The time in which any act provided by law is to be done is computed by excluding the first day, and including the last, unless the last day is a holiday, and then it is also excluded." • Computed event, not a filing deadline. DO NOT ROLL: rule 8.500(e)(1) provides 'the date of finality is not extended if it falls on a day on which the office of the clerk/executive officer is closed', and 8.264(c)(1) lets the court modify on the next open day when the office is closed on the finality date. 'roll' is set to 'none' (outside the schema enum; engine must support no-roll). Exceptions final on filing: denial of supersedeas; dismissal on request or stipulation (8.264(b)(2)). Publication after filing restarts finality from the publication order (8.264(b)(3)); a modification changing the appellate judgment restarts from the modification order (8.264(c)(2)). Writ proceedings: see 8.490(b).
  • If the clerk's office is closed or inaccessible on the last day (weather, emergency or local closure orders), the deadline may be extended. Check local orders.

Worked example

Filing date of the Court of Appeal decision (or of a later publication order, judgment-changing modification order, or filed consent) on Monday, March 15, 2027, personal service: due Wednesday, April 14, 2027.

  1. Trigger (Filing date of the Court of Appeal decision (or of a later publication order, judgment-changing modification order, or filed consent)): Monday, March 15, 2027.
  2. Exclude the trigger day and count 30 calendar days: Wednesday, April 14, 2027.

Unsettled points

  • The calculator shows Supreme Court finality on the unrolled day 30, so dates chained from finality start on the earlier date, matching Court of Appeal finality.Other reading: If finality rolled with CRC 1.10(b), it would fall on the next court day and chained dates would be one to three days later.
