- Backward version of the same 15-day notice requirement. Applies to 1203.4 (probation dismissal), 1203.41 (county jail / mandatory supervision), and 1203.42 (pre-realignment prison sentence now eligible for county jail). The statutes do not say whether the 15 days run from personal delivery or mailing, or whether CCP 1013 adds days for mail; the calculator counts from the date notice was given (served).
- If the clerk's office is closed or inaccessible on the last day (weather, emergency or local closure orders), the deadline may be extended. Check local orders.
This calculator applies the cited rules to the dates you enter. It is not legal advice. Court orders, local rules, and case-specific facts can change a deadline; verify before relying on it. Rule set pending attorney review.
Worked example
Hearing (or ruling) date on the petition on Monday, March 15, 2027, personal service: due Friday, February 26, 2027.
- Trigger (Hearing (or ruling) date on the petition): Monday, March 15, 2027.
- Count back 15 calendar days: Sunday, February 28, 2027.
- That day is a Sunday. Counting backward, this calculator uses the earlier court day so the full notice period is preserved: Friday, February 26, 2027 (see Cal. Code Civ. Proc. 12c).
Unsettled points
- When notice is mailed, the calculator adds 5 days (10 out of state): serve the prosecutor 20 days before the hearing, and the earliest grant is day 20.Other reading: If CCP 1013 does not apply, the service date is 5 days later and the earliest grant 5 days sooner.
