Official source
  • Family law only (civil limited scope uses CRC 3.36). extensions none: the rule counts '10 calendar days from the date that the [notice] was served'; whether CCP 1013 adds days for mailed service is not addressed, so the unextended date is shown (conservative for the client). REVIEW. If no objection, attorney serves and files the 'Final' FL-955 and is relieved on service.
  • If the clerk's office is closed or inaccessible on the last day (weather, emergency or local closure orders), the deadline may be extended. Check local orders.

This calculator applies the cited rules to the dates you enter. It is not legal advice. Court orders, local rules, and case-specific facts can change a deadline; verify before relying on it. Rule set pending attorney review.

Worked example

Date the proposed Notice of Completion (FL-955) was served on the client on Monday, March 15, 2027, personal service: due Thursday, March 25, 2027.

  1. Trigger (Date the proposed Notice of Completion (FL-955) was served on the client): Monday, March 15, 2027.
  2. Exclude the trigger day and count 10 calendar days: Thursday, March 25, 2027.

Unsettled points

  • The calculator adds CCP 1013 mail days to the 10-day Fam. Code 5271(c) service deadline, so a mailed motion goes out 15 days before the hearing; response periods stay unextended.Other reading: If CCP 1013 does not apply, mailed service 10 days before the hearing is enough.
