- WIC 321 says "within 10 days" (calendar days); the statute controls over CRC 5.674(e) "10 court days". AMBIGUITY: WIC 321 says 'within 10 days' (calendar days on its face, CCP 12) while CRC 5.674(e) says '10 court days'. 10 court days is longer than 10 calendar days; a statute controls over a conflicting rule. CONSERVATIVE: use 10 calendar days from the request. This entry follows the rule text; lawyer review required. Modeled as 10 calendar days per WIC 321 (statute controls over CRC 5.674(e) '10 court days'). [Validation 2026-11, Q0085. Authority: Welf. & Inst. Code 321]
- If the clerk's office is closed or inaccessible on the last day (weather, emergency or local closure orders), the deadline may be extended. Check local orders.
This calculator applies the cited rules to the dates you enter. It is not legal advice. Court orders, local rules, and case-specific facts can change a deadline; verify before relying on it. Rule set pending attorney review.
