CCP 12: "The time in which any act provided by law is to be done is computed by excluding the first day, and including the last, unless the last day is a holiday, and then it is also excluded." CCP 12a(a): "If the last day for the performance of any act provided or required by law to be performed within a specified period of time is a holiday, then that period is hereby extended to and including the next day that is not a holiday. • Applies to assessment debts arising on or after Jan. 1, 2006 (5715(a)). Redemption procedure is governed by CCP 729.010 et seq. (not researched here). Whether the period extends if day 90 is a weekend or holiday is not addressed; CCP 12a would ordinarily extend an act's last day, but redeem by the computed day to be safe. Notice of sale must state the property is sold subject to this right. Statutory last day rolls under CCP 12a / Civ. Code 10 if day 90 is a weekend or holiday; the unrolled date is the owner's safe date. A buyer should not treat redemption as foreclosed until the rolled date. [Validation 2026-11, Q0320. Authority: Cal. Civ. Code 5715(b); Cal. Code Civ. Proc. 12a(a); Cal. Civ. Code 10]

Unsettled points

  • The calculator shows the unrolled day 90 as the owner's last day to redeem, the earlier date.Other reading: Under CCP 12a and Civ. Code 10, a weekend or holiday day 90 rolls to the next court day, so a later redemption may also be timely.
