Named executor petitions for administration (or risks waiver of right to appointment)
30 days after date the named executor knew of the death and that the person is named as executor (the later of the two), under Cal. Prob. Code 8001.
Rule text
Unless good cause for delay is shown, if a person named in a will as executor fails to petition the court for administration of the estate within 30 days after the person has knowledge of the death of the decedent and that the person is named as executor, the person may be held to have waived the right to appointment as personal representative.
Calculate this deadline
- Trigger (Date the named executor knew of the death AND that the person is named as executor (the later of the two)): Friday, November 6, 2026.
- Exclude the trigger day and count 30 calendar days: Sunday, December 6, 2026.
- That day is a Sunday, so the deadline moves to the next court day: Monday, December 7, 2026 (Cal. Code Civ. Proc. 12, 12a, 12b, 10, 17(b)(4), applied to probate proceedings by Prob. Code 1000; Cal. Rules of Court, rule 1.10).
