- For residential tenancies, an OWNER'S notice is governed by Civ. Code 1946.1 (60 days, or 30 days if under one year), which applies 'Notwithstanding Section 1946'. Civ. Code 1946 remains the rule for tenant notices and for non-qualified commercial tenancies. The parties may agree at the outset to a notice period of not less than 7 days (1946(a)). If the tenant gives notice and fails to deliver possession, UD lies under CCP 1161(5).
- If the clerk's office is closed or inaccessible on the last day (weather, emergency or local closure orders), the deadline may be extended. Check local orders.
