CCP 12: "The time in which any act provided by law is to be done is computed by excluding the first day, and including the last, unless the last day is a holiday, and then it is also excluded." CCP 12a(a): "If the last day for the performance of any act provided or required by law to be performed within a specified period of time is a holiday, then that period is hereby extended to and including the next day that is not a holiday. - Default rule; yields to a specific statute (e.g., claim and delivery CCP 515.030 runs from levy/filing; third-party claims CCP 720.140(b)). Applies to attachment undertakings through CCP 489.010, which incorporates the Bond and Undertaking Law. Objection is by noticed motion; hearing must be held not less than 2 nor more than 5 days after service of the notice of motion unless the parties agree (995.950(a); court-scheduling window, not modeled). Extensions set to general (period runs from service; 995.030 incorporates general civil service rules); LAWYER REVIEW: conservative practice is to object within the unextended 10 days. Waiver of objections if late.
- If the clerk's office is closed or inaccessible on the last day (weather, emergency or local closure orders), the deadline may be extended. Check local orders.
