Execution sale of real property: notice of sale may not be given until 120 days after notice of levy was served on the judgment debtor
120 days after date notice of levy on the interest in real property was served on the judgment debtor, under Cal. Code Civ. Proc. 701.545.
Rule text
CCP 701.545: "Notice of sale of an interest in real property, other than a leasehold estate with an unexpired term of less than two years at the time of levy, may not be given pursuant to Section 701.540 until the expiration of 120 days after the date notice of levy on the interest in real property was served on the judgment debtor."
Calculate this deadline
- Trigger (Date notice of levy on the interest in real property was served on the judgment debtor): Friday, November 6, 2026.
- Exclude the trigger day and count 120 calendar days: Saturday, March 6, 2027.
- That day is a Saturday, so the deadline moves to the next court day: Monday, March 8, 2027 (Cal. Code Civ. Proc. 12, 12a, 12b, 10; Cal. Rules of Court, rule 1.10).
- The period includes its last day, so the earliest day to act is the next court day: Tuesday, March 9, 2027.
