How these dates affect deadlines

When a filing deadline lands on a holiday or a weekend, the rules usually move it to the next day the court is open; deadlines counted backward from a hearing move earlier. The deadline calculator applies this table automatically and shows each step with the rule text.

Gov't Code 662.003(a) national holidays: New Year's Day, MLK Jr. Day (third Monday in January), Presidents' Day (third Monday in February), Memorial Day, Independence Day, Labor Day, Veterans Day (Nov. 11), Thanksgiving, Christmas. 662.003(b) state holidays: Confederate Heroes Day (Jan. 19), Texas Independence Day (Mar. 2), San Jacinto Day (Apr. 21), Emancipation Day in Texas (June 19), LBJ Day (Aug. 27), the Friday after Thanksgiving, Dec. 24, Dec. 26. 662.003(c): "An 'optional holiday' includes only the days on which Rosh Hashanah, Yom Kippur, or Good Friday falls." WEEKEND HOLIDAYS: the Comptroller states "Offices will not be closed on another day when designated holidays fall on a Saturday or Sunday. Such holidays will not be observed." There is no Friday/Monday substitute day for state purposes (e.g., July 4, 2027 is a Sunday; Texas does not observe Monday July 5, 2027, unlike the federal government). Weekend holidays are listed below for completeness but have no effect beyond the Saturday/Sunday rule. SKELETON-CREW STATE HOLIDAYS (Confederate Heroes, Texas Independence, San Jacinto, Emancipation, LBJ): Gov't Code 662.004(a) requires agencies to keep "enough employees on duty during a state holiday to conduct the public business," so state offices are open on these days. OPTIONAL HOLIDAYS: state offices stay open; individual employees may take them in lieu of a skeleton-crew holiday (662.006). AMBIGUITY A LAWYER SHOULD REVIEW: TRCP 4 does not define "legal holiday", and the list in Gov't Code 662.003 is written for state-employee leave. Whether a skeleton-crew state holiday or an optional holiday is a "legal holiday" that extends a TRCP deadline is not answered by the rule text. Also, district and county clerk offices are county offices whose closure days are set locally and may differ from the state schedule (some counties close on days the state does not, and vice versa). Recommended conservative product behavior: treat all national holidays and the state holidays on which ALL state agencies close (Friday after Thanksgiving, Dec. 24, Dec. 26) as deadline-extending; DO NOT rely on skeleton-crew or optional holidays to extend a deadline (flag them), and check the specific county's court holiday schedule. FY2028 (Sept. 2027 to Aug. 2028) state schedule has NOT been published; Sept. to Dec. 2027 entries below are derived directly from the fixed and formula dates in Gov't Code 662.003 and are marked as such. Rosh Hashanah and Yom Kippur 2027 are omitted because their dates are not stated in any official Texas source located (they fall on lunar-calendar dates).
