- AMBIGUITY: 'within five working days of his or her birthday' does not say before or after. Modeled as the last day after the birthday; conservative practice is to update on or before the birthday. 'Working days' is not defined in the Act; counted here as court days (Saturdays, Sundays and judicial holidays excluded). A registering agency's own closures may differ; advise registering well before the last day, since failure to register is a crime. Transients have the same annual duty (290.011(c)). SAFE DATE: 5 calendar days. 'Working days' is undefined; court days skip judicial holidays on which the registering agency may be open, so the court-day date can be later than the agency's count. - If the clerk's office is closed or inaccessible on the last day (weather, emergency or local closure orders), the deadline may be extended. Check local orders.
This calculator applies the cited rules to the dates you enter. It is not legal advice. Court orders, local rules, and case-specific facts can change a deadline; verify before relying on it. Rule set pending attorney review.
Worked example
Registrant's birthday in the current year on Monday, March 15, 2027, personal service: due Monday, March 15, 2027.
- Trigger (Registrant's birthday in the current year): Monday, March 15, 2027.
- Exclude the trigger day and count 0 calendar days: Monday, March 15, 2027.
Unsettled points
- The calculator shows 5 calendar days for registration because failure to register is a crime and 'working days' is undefined.Other reading: If 'working days' means agency business days, the deadline is about 2 to 4 days later.
- The calculator shows the annual update due on the birthday itself (prior court day if a weekend), which is inside the window under both the before and after readings.Other reading: If the window runs after the birthday, the update is timely up to 5 working days later; on a weekend birthday the two readings cannot both be met.
